there is relevance in the study of the concept of law and in my study of Computer ethics. Actually, because my field of industry is not related in computing, computer laws I don’t mind if many people around the net will hack, steal properties like programs, put viruses and other else. Impact I admired those person who can do these things. How they have done all of these things? That’s a big Wow to me. Honestly speaking they are brilliant in some way. What I don’t want is that hackers, programmers & the like use there God’s given talent to steal property. Example is that accessing World Bank, hackers can steal money from the bank just deposit it trough another account with the use of computer which is very bad. And in that is “bawas pogi points”. I just believe that I can hack but there is limitations that I will not do anything harm just to gain money. Which as far as I’m concern stealing one’s property is truly bad and in that I know I committed a sin. I will violate the Divine Law which is the judge is God’s alone. As I’ve study it, it is clearly in my mind that whatever laws in the land, must be clearly obeyed and followed so that I will not violate the law. Now, it’s very clear to me. In computer ethics professionalism is a must. Being in the IT field we must act as a professional. Professional meaning whatever law in computing must be strictly implemented and obeyed. Also determining what is right and wrong. The law protects the right and intellectual property of the people, customs and beliefs thus respecting one’s owned must be private. I’ve learned too much in studying computer ethics. It makes me change what I have believed. That’s why no to computer hackers, it’s a very private property. The concept of law made a Standard Operating Procedure that is, it must be strictly implemented. The authorities who made this law are not just only one person, but they are many considering not only for their own benefit but for all human kind. Protecting the intellectual property, rights and the privacy of the people is the concept of law. Considering before the law was made, decided researching and thorough studying is done and the basis of this law is the ethical principles of Computer. Without Computer Ethics how come they put up a law? Before the law is enacted and decided the basis of this law is the principle of ethics. That is the relevance.
2. List down two laws governing computer use and explain what types of non-jural law seem to underpin these two laws.
v Hacking- thou shall not snoop around in others people file. People’s other file is so private that we must respect their privacy. Sometimes even it is too private accessing the web or the domain for curiosity and for own benefit even it’s bad, we are eagerly looking for it. “Bad is always a very delicious one”, Yummy. Money is in our mind. Hacking involves unauthorized access to a computer, files and programs. The main reason why is hacking is around the world it is because of stealing, taking valuable files such as credit card, numbers and list of customer. Sometimes programmers use hacking for revenge. Well, the types of non-jural law that underpin this law is:
· Divine Law – hacking is a sin. Snooping others file and stealing violates the 10 commandment of God. Thou shall not steal. Although there is no computer in that time, God is so powerful He knows what will happen. He knows that His creation will steal things just to gain profit from that. Also, revenge is a sin. The revenge is mine says the Lord. No one has the authority to revenge. The revenge is for God’s alone.
· Natural Law – there is a law in the land, enacted and institutionalized by men that thou shall not use computer to steal, to harm the intellectual property of mankind. It is not just, too unfair if we steal property that is not belong to us. Anyway, people become rich because they been so hard working, industrious and patient. That is the fruit of their labor, if hackers will steal property from them it is like trigging a bullet from a person to be killed. Remember always there is the law in the land.
· Moral Law – hacking does not respect the rights of the owner’s intellectual property; it is also a form of cheating. Hacking also is a crime and a computer abuses. “Honesty is the best policy”. Hacking violates the moral law. Hacker’s behavior is not good as if they will use it for revenge.
· Physical Law – ones hackers do it all the time he wants, regularity and imperativeness comes.
v Damaging one’s reputation through the use of Computer. Thou shall not use a computer to harm other people.
God Created Eve to be a help to Adam. But God does not created Eve just to abuse by men to dishonor the decency of a woman. Nude pictures of women in the internet even it is faked and altered has been thoroughly spread in the World Wide Web. Men are enjoying to see this wonderful photos. Oh boy. That is the lust of the flesh. Damaging one’s reputation and it is too bad. If my pictures will be there in the nude style or position although it’s not my body. Well I feel very a shame. I will see to it that person who use my photo’s will be in prison. “Nakakahiya Talaga”. Damaging one’s reputation is very bad. The types of non-jural law that underpin this law are:
· Divine Law – If the eye is the cause to make you sin then threw it into the fire. Well, I’m not saying take away your eyes physically because you can’t see. That’s very wrong what am I trying to say is that don’t use your eyes for lusty things. Also don’t use God’s given talent just to put nude photos in the internet. Although most men’s are the author of all these things in the internet just to satisfy the eagerness for sex, it must be avoided. No men will dishonor the reputation of a woman because it will violate the law of God. If a man feel there basic need to woman as if they are sinning, they have their evil thoughts and strong desire the best way not to publish nude photos in the WEB is to pray. Divine Law is the hardest thing to obey and easiest way to disobey.
· Natural Law – There is a law stating no to pornography. It is not righteous if programmers and hackers will publish nude photos in the Web. That is a crime and punishable by law.
· Moral Law – Those person who publish nude photos in the internet are very immoral, no ethics at all. They are wicked and crazy.
Case of Melinda
Copying is not merely bad for me if you will use it to have a new idea. That’s for reference. But of course, if you copy the assignment of your classmate as is that is a very wrong idea. That is my point. In the case of Melinda her action done is unethical. She knew that buying license software is expensive. I have a strong feeling that she has a plan already in her mind before she buys license software. There is a wrong motive behind her but she’s not yet executing it or putting it into action. One day she’s decided to buy the license software which she knows it is expensive. In her mind it’s alright to buy the license software in higher price because she will reproduce copies to be sold to her friends and acquaintance to make her money back and not that all to gain profit from that software. That makes her violating the law. Once a plan is in your mind alone your not yet violating the law but if you put it into actions then violation comes. She violates the Natural law.
Natural Law
What Melinda’s action is unjust, unfair & unrighteous? It’s too unfair to Cyberzone who owned that computer software. Cyberzone will not get any profit to the copies made by Melinda. Melinda must respect the rights of Cyberzone, the intellectual property. They are the only one who can reproduce that. “ Kung sa Palagay mo ay Tama ka” do it, but if your conscience are telling or dictating you that it is wrong just stop it. Anyway, if you by pass the belief, custom & rights of others violating the natural law you must know the consequence of your actions.
Divine Law
In divine law it’s different. Because were talking about the perfection of God, the perfection of human being. I myself personally disobeyed the Divine Law of God. Yes, it’s too difficult to obey God. Many times I violate the Divine Law of God. Thus telling it’s too easy to violate it. As I always say, I’m only human bound to make mistake. As stated, even if you do not translate your evil thoughts into action you committed a sin. Melinda committed a sin, she has an evil thought, a strong desire and in fact she has a motive of selling copies to her friends. In Divine Law God is always searching and checking our hearts. He is always looking the true heart of a person, checking the heart of his mater piece.
Moral Law
Melinda also violates the moral law. Her actions and intentions are not good thus she violates the moral law. Melinda copies the licensed software and sells it to her friends and acquaintance. She knew that she will violate the law. Melinda does not respect the rights of Cyberzone the intellectual property, she does not even comply with the computer norms and law. Plus honesty is the best policy.
Physical Law
I doubt if Melinda’s action violates the physical law. May be if Melinda do it regularly. Make it as her business and the like then it violates the physical law. As stated the main characteristic of physical law is regularity and imperativeness. It is regular because once it becomes operative; its efficacy remains constant and unbreakable. It is imperative because it is permanent and unchangeable. Although Melinda executed her plan and sold pirated software, it is not clearly stated if she just wants to return her money back that’s why she’s selling the pirated software or she do that for making it as a business thus operating regularly. In that case she violates the physical law.
